For what purpose do we process your data?

This Entity processes the information obtained for the purpose of processing administrative files and the actions derived from them.

How long will we keep your data?

We store data for the time necessary to comply with the legal obligations required by administrative regulations, and always complying at least with the minimum retention time for the information. In accordance with Article 26 of the LOPD-GDD, it will be lawful for this Entity to process data for archiving purposes in the public interest, always complying with current archiving and documentation regulations.

Existence of automated decisions?

This Entity may make automated decisions based on the legal coverage granted by Article 41 of Law 40/2015, of October 1, on the Legal Regime of the Public Sector. This would be any act or action carried out entirely through electronic means within the framework of an administrative procedure and in which a person has not directly intervened.

Automated decision-making must be regulated in its own regulations, defining the specifications, programming, maintenance, supervision, and quality control in the same. Such regulations will be available to citizens on the electronic headquarters of this Entity.

What is the legal basis for processing your personal data?

The legal basis for processing your data is the fulfillment of a mission carried out in the public interest or in the exercise of public powers, in accordance with Law 39/2015, of October 1, on Common Administrative Procedure.

To which recipients will your data be communicated?

Data will be communicated to other Public Administrations whenever necessary to fulfill the purposes listed above, provided there is legal regulation supporting it.

In addition, the Entity has contracted the GESTIONA tool with the company ESPUBLICO SERVICIOS PARA LA ADMINISTRACIÓN S.A., which is the data processor according to the processing agreement signed between the parties.

What are your rights in relation to the data provided?

Any person has the right to obtain information about whether this Entity is processing their personal data or not.

Interested parties have the right to access their personal data, the retention period of their data, and even to obtain a copy of the data being processed.

Likewise, they have the right to rectification of data if it is inaccurate. (For example, you can request a correction of your address, a name change, etc.).

Interested parties have the right to restriction of processing, for which they must request it from the controller, who must suspend data processing when citizens request rectification or deletion of their data, until their request is resolved.

Interested parties may exercise the right to erasure (right to be forgotten) provided the circumstances listed in the GDPR are met and according to Article 15 of the LOPD-GDD.

The affected person may exercise the right to object to processing, always for reasons related to their personal situation, except where a legitimate interest is proven, or it is necessary for the exercise or defense of claims. Likewise, when the processing is for direct marketing purposes.

The interested party will have the right to portability to obtain data in a structured, commonly used, and machine-readable format, and to transmit it to another data controller when the processing is based on consent or is carried out by automated means.

Interested parties may exercise the rights listed in the previous paragraphs through the forms available on the electronic headquarters of this entity or by sending a written request by post.

When can I exercise the right to file a complaint with the Supervisory Authority?

You may file a complaint with the competent Supervisory Authority on Data Protection, especially when you have not obtained satisfaction in the exercise of your rights, by writing to the Spanish Data Protection Agency, C/Jorge Juan nº 6, 28001 Madrid or by accessing its electronic headquarters: https://sedeagpd.gob.es/sede-electronica-web/
